Owner's and Lender's Title Insurance

The lender's title insurance policy insures a lender who has a lien secured by the land that is the subject of the transaction. Unfortunately, the lender's policy does not benefit the owner in the event of a claim. Only an owner's policy will insure you as the owner of the land against a claim that you don't have full ownership rights, whether it be a problem in the "chain of title" such as a forged deed or a future claim like someone claiming title to a portion of your property through adverse possession. An owner's title insurance policy lasts your entire lifetime, even guarding you against claims after you have sold the property. Under Virginia law, we are required to inform you about the availability of owner's insurance and give you the chance to obtain this coverage.

Title Insurance Fees and Premiums

At closing, you can expect to pay a title search fee, an insurance premium, and a binder fee. The title search fee is the cost to obtain a current search of the property, which will be brought up to date on the moment the documents are put to public record in the courthouse. A binder fee is a charge to "preview" the title. The title insurance premium is a one-time charge that provides coverage forever.
